Apesar da separação de competências entre o Tribunal de Justiça da União Europeia e os tribunais nacionais, e da autonomia processual de cada Estado-Membro, o Tribunal de Justiça da União Europeia tem tratado da questão de saber quando as leis processuais nacionais dos Estados-Membros devem ser postas de lado à luz do direito da UE e como o ónus da prova em litígios em matéria de IVA deve ser repartido entre os sujeitos passivos e as autoridades fiscais. Este trabalho apresenta uma análise das regras da União Europeia em matéria de imposto sobre o valor acrescentado e da jurisprudência do Tribunal de Justiça da União Europeia, estabelecendo como deve ser repartido o ónus da prova em litígios relativos ao IVA.
