Dieser Beitrag befasst sich mit zwingenden Präzedenzfällen in der Arbeitsgerichtsbarkeit, basierend auf dem Phänomen der Einbeziehung von Elementen der Common Law Familie in die brasilianische Civil Law Familie. Die angewandte Methode befasst sich mit beiden Rechtsfamilien in Bezug auf Definition, Aufbau, historische Entwicklung und aktuelle Struktur im englischen, nordamerikanischen und brasilianischen Rechtssystem. Letztere wiederum wird mit einem Schwerpunkt auf dem Anwendungsbereich des Arbeitsverfahrensrechts und des Zivilverfahrensrechts analysiert, insbesondere in Bezug auf die Gesetzesreform der Konsolidierung der Arbeitsgesetze (CLT), die durch das Gesetz Nr. 13.015/2014, die neue Zivilprozessordnung, gefördert wurde, die gemäß ihrem Artikel 15 und Artikel 769 der Konsolidierung der Arbeitsgesetze ergänzend und subsidiär auf das Arbeitsverfahren anwendbar ist, was einen Meilenstein in der Annahme des Systems der gerichtlichen Präzedenzfälle durch die Arbeitsgerichte im brasilianischen Rechtssystem darstellt. Ziel dieser Dissertation ist es, aus einer nicht-positivistischen Perspektive den Nutzen oder Nachteil der Einbeziehung der Präzedenzfalltheorie in das brasilianische Arbeitsverfahrensrecht und die Arbeitsgerichtsbarkeit aufzuzeigen.
