The WTO’s regulation of the use of trade remedies has brought into sharp relief the dynamics of the power relationships of countries settling their disputes within the multilateral trading system, whether the power relationships influence decisional outcomes, and the implications for mediating between the goals of trade liberalization and trade restriction inherent in the use of trade remedy measures. This book provides a detailed analysis of some landmark rulings of the Appellate Body on issues of dumping, subsidies and safeguards and examines the relationship between the outcomes of those decisions and the power (im) balance within specific disputes and whether the particular power configuration of the countries involved in specific cases impact the decisions of the Appellate Body in cases where activist rulings are identified. This book will be of interest to lawyers, academics, and any reader concerned with the implications of the global regulation of trade remedies within the World Trade Organization with respect to domestic regulatory autonomy, and the effect of the power configuration of countries involved in dispute settlement over the use of these remedies.
