O processo de mediação adopta as regras do contencioso civil na sua aplicação. Estas regras são visíveis na aplicação e nos resultados da mediação. Assim, a fim de reforçar o processo contratual ou de resolver os litígios extrajudicialmente, a intervenção do juiz é muitas vezes necessária para o equilíbrio contratual. A intervenção do juiz no contrato, que é da competência das partes, confere-lhe amplos poderes. No entanto, há que referir que a influência do juiz no processo de mediação pesa por vezes ou impede o bom funcionamento da mediação no âmbito do direito OHADA.
