Este livro apresenta uma descrição e uma análise da questão dos direitos dos povos indígenas à luz do direito internacional, aplicando-a à situação específica dos povos indígenas do Canadá e da Guiana Francesa, nomeadamente no que diz respeito à questão dos direitos coletivos. Este projeto insere-se, portanto, numa problemática que visa analisar o impacto da consideração dos povos indígenas a nível internacional nas suas situações nos respetivos Estados, no reconhecimento dos seus direitos e, mais especificamente, no reconhecimento dos direitos coletivos, o que estará no centro deste trabalho enquanto direitos fundamentais com incidência sobre os diversos outros direitos dos povos indígenas. Nos últimos 25 anos, os direitos dos povos indígenas têm vindo a ocupar progressivamente um lugar cada vez mais importante nos debates sobre os direitos humanos a nível internacional, o que permitiu, paralelamente, uma evolução notável a favor do reconhecimento desses direitos. Três instituições têm-se interessado particularmente por esta questão: as Nações Unidas, a Organização dos Estados Americanos e a Organização Internacional do Trabalho.
