Este livro surge com um objetivo muito claro: iluminar as alterações que o Direito Internacional recebeu nos últimos cinquenta anos, em especial no que se refere a potencial correlação entre as normas peremptórias do Direito Internacional, os Direitos Humanos, o Processo Legal Transnacional e, por fim, os Tribunais Internacionais.O Direito Internacional mudou consideravelmente desde a Segunda Guerra Mundial, seja pelo crescimento do número de atores e sujeitos que interagem no cenário internacional, seja pela reestruturação de valores ocorrida com os Direitos Humanos, seja pela confluência de um número de tratados internacionais que hoje vinculam os Estados. Todos estes fatores produziram intensas reestruturações na figura do Direito Internacional. O intento é não apenas apresentar as teorias que sustentaram estas alterações, mas também relacionar possíveis soluções práticas oriundas das interações ocorridas na atual conjuntura do cenário internacional. Neste objetivo é que se elegeram os Direitos Sociais, mais especificamente o Direito à Educação, para que servissem de ilustração destas mudanças e de possíveis ações através dos Tribunais Internacionais. 10
