This book presents a comprehensive study of mediation as a basic mechanism for resolving family conflicts in Ecuador, specifically with regard to aspects related to visitation and alimony. The study is based on a historical review of mediation, which is a practice with ancestral roots, based on dialogue and subsequently adopted by modern legal systems as an alternative to justice. In Ecuador, its consolidation is based on the Arbitration and Mediation Law of 1997 and acquires greater robustness with the Constitution of 2008, which gives it a higher rank by recognizing it as a right and as part of the public service of justice.The research covers the corresponding legal framework, i.e., the Constitution, the Organic Code of Children and Adolescents, the COGEP, the Civil Code, among others, which present principles such as the best interest of the child, celerity, equality, autonomy of will, dignity, legal pluralism, among others.
