A República Democrática do Congo (RDC), anteriormente considerada vulnerável ao financiamento do terrorismo, enfrenta agora ameaças terroristas internas. Esta mudança está relacionada com o surgimento de grupos terroristas ativos que põem em risco a segurança nacional. Para combater esta ameaça crescente, o quadro jurídico congolês baseia-se no Código Penal Militar e na Lei n.º 22/068, de 27 de novembro de 2022, relativa ao branqueamento de capitais, ao financiamento do terrorismo e à proliferação de armas de destruição maciça. Existem também instituições especializadas. Apesar deste quadro, a eficácia da luta continua a ser prejudicada por lacunas na legislação e por desafios institucionais. Em março de 2024, a RDC levantou a moratória sobre a pena de morte para intensificar a luta contra o terrorismo, uma reforma que atrai a atenção e suscita debates sobre a sua eficácia e impacto nos direitos humanos. Neste contexto, é imperativo reavaliar e adaptar a resposta jurídica da RDC face a esta ameaça crescente.
