Parmi les aspects du TTIP perçus comme préjudiciables par l’opinion publique, l’un d’entre eux semble être considéré comme le plus controversé : l’inclusion du mécanisme de règlement des différends entre investisseurs et États (ISDS), sur lequel la Commission européenne a décidé de lancer une consultation publique. Selon les personnes interrogées, l’ISDS représente une menace pour le droit de l’État à réglementer, en particulier dans certains domaines sensibles tels que la protection de l’environnement, la santé et le travail. En effet, on suppose que les gouvernements, s’ils introduisent des réglementations de politique publique affectant les investissements, pourraient être exposés à des réclamations coûteuses de la part d’entreprises étrangères, déclenchant ainsi ce que l’on appelle l’effet de refroidissement réglementaire (regulatory chill effect). Cette étude est divisée en deux parties : la première partie (chapitre 2) analyse si les craintes suscitées par la clause ISDS sont justifiées et s’il existe des alternatives possibles à cette option. Après avoir précisé les significations juridiques du refroidissement réglementaire et du droit de réglementer , dans la deuxième partie (chapitre 3), ce document aborde la question complexe de la recherche d’un équilibre entre les deux intérêts opposés des parties au TTIP: le droit de réglementer et la protection de l’investissement.
