L’influence du droit international des droits de l’homme sur le droit des investissements apparait à travers deux prismes : sur le plan des sources et sur le plan du contenu. Concernant les sources, les foyers nationaux et internationaux qui ont trait à l’investissement sont dans l’ensemble mobilisés pour l’intégration des droits de l’homme dans le droit des investissements, mais cette opération se heurte à des obstacles liés à la fragilité des cadres normatifs empruntés. Relativement au contenu, c’est-à-dire la réalité effective du droit des investissements, celle-ci révèle l’existence des droits de l’homme, mais beaucoup plus du côté des investisseurs que du côté des États, en raison des concepts généreux souvent mobilisés au soutien de la protection des investisseurs.En revanche, des tendances nouvelles se font peu à peu jour et procèdent de l’avènement de nouveaux concepts qui penchent vers la protection de l’État et donc sa population. Mais là encore, aucune véritable mise en œuvre n’est garantie, et ce, en raison de l’absence de mécanismes adaptés.
