O presente livro tem por objetivo apresentar de forma sucinta os casos em que os tribunais romenos têm o direito de aplicar a um determinado contrato uma lei diferente da escolhida pelas partes para o reger. Todos estes casos constituem limites ao princípio da autonomia das partes no Direito Internacional Privado. Estes limites representam geralmente quer o património cultural ou histórico do sistema jurídico do tribunal respetivo, quer o esforço do legislador para proteger os seus próprios cidadãos. No âmbito do direito internacional privado romeno, os limites ao princípio da autonomia das partes que constituem o objeto do presente estudo são os seguintes: ordem pública, disposições imperativas, fraude, impossibilidade de determinar o conteúdo de uma lei estrangeira, inexistência de um elemento estrangeiro e exigência de que as regras escolhidas pelas partes sejam leis e não regras de direito.
