L’abolition de la peine constitue une négation du droit à la vie et qui soulève d’importantes questions en matière de droit de l’homme. Aucun système judiciaire n’est parfait. Dans la pratique, la décision de mettre quelqu’un à mort est souvent arbitraire, et les plus désavantagés sont généralement les pauvres, et les faibles. La note circulaire du gouvernement Congolais (RDC) du 13 Mars 2024 portant levée du moratoire sur l’exécution de la peine de mort en RD Congo constitue une marche en arrière pour le pays, ignorant tous les acquis et avancées enregistrés par le pays en matière des droits de l’homme et, cette dernière viole les traités internationaux ratifiés par la RDC, à l’occurrence le Statut de Rome de la Cour Pénale Internationale, la Charte Africaine des droits de l’homme et des peuples, et le pacte international relatif aux droits civils et politiques du 16 décembre 1966. Le plus souvent une quantité alarmante de faits établis indique également que même les systèmes judiciaires les plus avancés ont condamné à mort des hommes et des femmes reconnus innocents par la suite. Lorsqu’une erreur judiciaire entraîne la mort de quelqu’un l’État devient un meurtrier.
