Angoisse, peur, crainte... En droit français, le langage des émotions prend une place de plus en plus importante. Face à une situation dommageable, il devient courant de solliciter une indemnisation portant spécifiquement sur les émotions négatives qui auraient été ressenties. En réponse, la Cour de cassation a créé plusieurs préjudices nommés et autonomes, visant apparemment à indemniser ces émotions négatives.Les situations visées par ces préjudices ne sont pas spécifiquement françaises. En Angleterre aussi, des actes terroristes font régulièrement des victimes, des ouvriers sont exposés à de l’amiante et des médecins manquent à leur devoir d’information. Pourtant, si le droit anglais de la tort law cherche des solutions face aux spécificités de ces situations, il s’avère moins perméable au langage des émotions.L’étude des préjudices émotionnels autonomes dans une perspective comparée permet de mieux saisir ce que ces préjudices visent à indemniser. Elle permet aussi d’éclairer d’un jour nouveau la condition de dommage, dont l’étude apparaît parfois délaissée en droit français et en droit anglais.
