Le imprese multinazionali sono diventate protagoniste del nuovo ordine economico mondiale. Il loro numero e il loro potere continuano a crescere nell’attuale ordine internazionale. Di fronte a questa crescita, si è acceso un dibattito. Qual è esattamente il loro status nel diritto internazionale? Esistono due tendenze opposte nel diritto internazionale per quanto riguarda lo status giuridico internazionale delle imprese multinazionali. Si tratta di quella minimalista e di quella massimalista. Alla fine del dibattito tra la visione minimalista e quella massimalista, abbiamo scoperto che le imprese multinazionali si trovano di fatto in un vuoto giuridico internazionale. Nessun trattato di diritto internazionale le riguarda. I pochi testi internazionali che le riguardano non sono vincolanti. La costante è che gli Stati non hanno la volontà di adottare norme severe nei loro confronti, ma anche la pressione esercitata da alcune imprese multinazionali. Ma questo vuoto giuridico non significa necessariamente che siano completamente assenti dal diritto internazionale. Il diritto internazionale ne tiene conto in altri modi.
