2021 est l’année du renouveau du droit de la famille et particulièrement du divorce. Un peu plus de quarante ans après la loi no 75-617 du 11 juillet 1975 qui a institué les fondements du divorce contemporain, le droit de la famille est bouleversé par une réforme majeure achevée en 2019 et applicable depuis le 1er janvier 2021. Dans un souci d’une bonne administration de la justice, le législateur a engagé une réforme d’ampleur modifiant la gestion du contentieux familial. D’une part, l’important mouvement de déjudiciarisation du divorce (2016) se conforme et connaît un nouvel essor en conférant aux avocats un rôle renforcé. D’autre part, un mouvement novateur d’unification du contentieux renouvelle la procédure du divorce judiciaire. Cet ouvrage dresse un tableau de ce nouveau divorce du XXIe siècle.
