La justice constitutionelle est une discipline des plus complexes que connait le droit. Elle est d’ailleurs à tort ou à raison perçue comme élitiste, même dans la communauté des juristes. Puisqu’elle traite des faits à la fois juridiques et politiques comme les élections. Ce contentieux est donc assez spécifique. Celà lui vaut très souvent des critiques sévères surtout en Afrique noire. Il n’est donc pas rare que certaines requêtes quittent le cadre juridique pour se loger dans la sphère exclusivement politique, faisant paraitre le juge comme incertain, puisque se trouvant à la croisée des chemins de l’application mécanique du droit et son dépassement par l’usage de compétences subliminales que lui confère la Constitution. Ce dilemme impose donc au juge une appréhension panoramique, tant juridique que politiste et sociologique. Ainsi, si se conformer au droit positif et, ou s’approprier un tacite champ compétentiel en matière processuelle pourraient paraître antinomiques, ces deux conceptions forment plus un duo qu’un duel. Cet ouvrage est une introduction à cette necessaire conciliation. En tout état de cause, le juge constitutionel doit la conquérir.
