Oggi, con l’avvento della guerra internazionale al terrorismo, tutto il diritto internazionale sembra essere in procinto di essere sfigurato. Dall’11 settembre 2001, infatti, il diritto internazionale nel suo complesso sembra essere stato colpito da un torpore e da una relativa incapacità di qualificare alcuni fenomeni, in particolare la lotta armata contro il terrorismo. Di fronte a questo silenzio, che sembra far rivivere l’'era del nominalismo', abbiamo assistito rapidamente ad amalgami. Infatti, mentre alcuni sostengono l’estensione del diritto internazionale umanitario (DIU) alla lotta armata contro il terrorismo, altri, invece, mostrano una certa resistenza. In questo clima di contraddizione, la determinazione del regime giuridico della lotta armata contro il terrorismo è diventata oggetto di una lotta dottrinale e spesso anche di un duello giudiziario, sottolineando così la difficoltà di definirne i contorni. Di fronte a questo movimento, che dà l’impressione di navigare a vuoto, la necessità di chiarire il regime giuridico della lotta armata contro il terrorismo e il suo rapporto con il diritto internazionale generale e, soprattutto, con il diritto internazionale umanitario, è imperativa. Questa è la visione della presente riflessione.
