Il conflitto palestinese si protrae ormai da diversi decenni. Il presente volume intende esaminare e analizzare criticamente se la Palestina soddisfi i requisiti di statualità previsti dal diritto internazionale e, in caso contrario, valutare l’esistenza di fattori che violano i presupposti necessari per soddisfare tali requisiti. Nell’esaminare il tema centrale, sarà necessario indagare e valutare una serie di questioni giuridiche distinte ma interconnesse, legate alla legittimità dell’occupazione israeliana secondo il diritto degli Stati, il diritto sull’uso della forza, il diritto internazionale umanitario, il diritto internazionale dei diritti umani, il diritto dell’occupazione militare e il principio di autodeterminazione. Tale valutazione e analisi dovrebbero essere utili ai professionisti del diritto internazionale o a coloro che stanno valutando prospettive progressiste in un campo del diritto molto nuovo e in evoluzione.
