El presente libro analiza la fundamentación jurídica de las decisiones en primera y segunda instancia del INDECOPI en el caso McDonald’s vs McHotel Ica. Además, evalúa el impacto de estas decisiones en la protección de marcas notoriamente conocidas y sus implicancias para la competencia en el mercado peruano. De este modo, se empleó un enfoque cualitativo para examinar los argumentos presentados por ambas partes y las justificaciones de las decisiones en ambas instancias. Se revisaron resoluciones del Indecopi y otros casos del Tribunal Andino, así como normativa relevante como la Decisión 486 de la Comunidad Andina y el Decreto Legislativo 1075. El estudio concluye que la protección de marcas notoriamente conocidas debe equilibrarse para evitar una sobreprotección que restrinja la competencia. El caso McDonald’s vs McHotel Ica, así como los demás casos analizados en el presente trabajo, nos presenta la importancia de establecer límites en la protección de dichas marcas y resalta la necesidad de criterios consistentes y alineados en las decisiones de las diversas instancias en materia de signos distintivos del Indecopi, para promover un entorno competitivo equitativo.
