En République Démocratique du Congo, la rationalité protectrice consacrée par la loi 09/001 du 10 janvier 2009 connait des difficultés dans sa mise en œuvre sur l’ensemble du territoire national et plus particulièrement en milieu rural. L’article 200 de la Loi portant protection de l’enfant stipule: Les tribunaux de paix et les tribunaux de grande instance pour connaitre respectivement en premier et second ressort des affaires qui relèvent de la compétence des tribunaux pour enfants qui seront installés et fonctionneront au plus tard dans les deux qui suivent la promulgation de la présente loi. Le Décret no 11/01 du 05 janvier 2011 fixant les sièges ordinaires et ressort des tribunaux pour enfants, en son article 1er stipule: Il est créé dans chaque ville et dans chaque territoire de la République Démocratique du Congo, une juridiction spéciale dénommée Tribunal pour enfant, en sigle TPE conformément à l’article 84 alinéa 1er de la Loi portant protection de l’enfant.
