Les acheteurs publics sont parfois confrontés à des situations d’urgence pour lesquelles la conclusion rapide d’un marché public de travaux, de fournitures ou de services s’impose. L’actualité nous livre l’exemple des dégâts provoqués par le passage d’une inondation, d’un incendie, d’un tremblement de terre, d’une guerre ou d’une crise sanitaire. Pour faire face à ces circonstances dangereuses, les règles de la commande publique ont proposé certaines mesures plus ou moins efficaces et rapides en fonction du degré d’urgence. En général, le maître d’ouvrage utilise deux modes pour passer des marchés publics, qu’ils soient en situation normale ou en situation d’urgence : il s’agit de l’appel d’offres et du gré à gré. Cependant, il a été constaté que le champ de fonction des marchés passés en urgence est limité car les marchés spéciaux et autres marchés spécifiques sont marginalisés par la réglementation camerounaise. Ceci va nous amener à élargir le champ de fonction de la passation des marchés en urgence et à poser la question de savoir quelle est la fonction de l’urgence dans ladite passation. Face à cette préoccupation, nous répondons simplement en disant que l’urgence dans la passation des marchés publics a une fonction de célérité affirmée et une fonction de négociation limitée. Cet ouvrage procédera donc à une systématisation des règles d’urgence dans la passation de tout type de marché public quelle que soit sa nature.
