Malgré l’existence de règles et de dispositions du droit international concernant les conflits armés et la reconnaissance de la légitimité des mouvements de libération au sein de l’État, son admissibilité est réduite en raison de la perte de l’un de ses piliers, à savoir l’autorité chargée de gouverner l’État, ainsi que d’une partie du territoire qui est sous l’occupation d’une autre force/État agresseur, en plus de la disponibilité des autres piliers, à savoir le peuple et l’adaptation entre les individus. Les populations veulent vivre ensemble sur le territoire de l’État, et il convient de noter que la poursuite des conflits armés menace l’idée de sécurité collective, qui est la principale raison de l’émergence des Nations unies et du Conseil de sécurité dans le droit international contemporain en tant que mécanisme permettant de la réaliser grâce au principe de l’interdiction du recours à la force dans les relations internationales et à l’établissement de cas légitimes spécifiques. Il inclut le recours à la force dans le texte de l’article sept, paragraphe 2, de la Charte des Nations unies, qui a été fondée sur les principes du droit international contemporain concernant le respect de la souveraineté des États.
