Esta obra del profesor Miguel Ángel Torrealba Sánchez realiza un estudio comparativo entre la Ley Orgánica de Procedimientos Administrativos de 1981 y sus antecedentes normativos, a saber: El Proyecto de Ley de Procedimientos Administrativos de 1965 (Proyecto Brewer-Carías-Martín-Retortillo-Rubio Llorente) y la Ley española de 1958 sobre Procedimiento Administrativo. Su conclusión general es que la LOPA venezolana tiene su base principal en el Proyecto de 1965, pero que también '...se enmarca en las tendencias del procedimiento administrativo iberoamericano, por lo que forma parte de la <> que fue surgiendo a partir del tronco común de la regulación procedimental española'.En lo que respecta a proponer un balance, el autor señala que en algunas regulaciones luce más idóneo el texto del Proyecto del 1965 (dada su coherencia) que la ley vigente (que sufrió cambios a la hora de su discusión), y en otros, al contrario, sin que ello implique un juicio de valor abstracto y conclusivo. Y ello, dado que '... las posiciones doctrinarias, como las propuestas normativas y los criterios jurisprudenciales, deben verse bajo el prisma del contexto en que surgieron'.
