Ce canon, perçu comme une exception - ou plutôt une atténuation - au principe de légalité, soulève des interrogations concernant le risque d’interprétations arbitraires pouvant compromettre les droits fondamentaux des fidèles. L’étude offre une analyse systématique et pastorale de cette norme canonique, en s’appuyant sur des cas jurisprudentiels issus de la pratique du droit canonique. Elle met en lumière le lien entre justice ecclésiale et protection du bien commun des fidèles. L’auteur propose en conclusion une reformulation du canon 1399 à la lumière de la finalité du droit pénal canonique et des exigences de justice et de dignité.
