Créée par le Traité révisé de la Communauté Économique des Etats de l’Afrique de l’Ouest (CEDEAO) du 24 juillet 1993 en tant que juridiction chargée du contentieux du droit communautaire CEDEAO, la Cour de Justice de la CEDEAO a vu ses compétences s’étendre au domaine du contentieux des droits de l’homme. En effet, le Protocole additionnel (A/SP.1/01/05) du 19 janvier 2005 a, en son article 9.4 conféré à cette Cour la compétence pour connaître des cas de violation des droits de l’homme sur le territoire des États membres de la CEDEAO. Cette position du juge communautaire CEDEAO, consistant à se reconnaître compétente pour appliquer des instruments juridiques dont le contrôle relève d’autres organes non juridictionnels ou juridictionnels peut, dans une certaine mesure poser la question de ses rapports avec ses organes. L’intégration de la Charte africaine des droits de l’homme et des peuples dans son droit applicable amène en effet à s’interroger sur les rapports qu’elle peut entretenir avec la juridiction continentale, la Cour africaine des droits de l’homme et des peuples.
