Enquanto alguns estados determinam o nexo sob a Cláusula de Comércio dos EUA com base em um teste de presença física, outros estados determinam o nexo usando um teste de presença econômica. Essa falta de uniformidade apresenta problemas para os contribuintes multistaduais. Para resolver essa questão, o Congresso dos EUA deve promulgar uma legislação que estabeleça um padrão de nexo uniforme para impostos sobre atividades comerciais.
