A atuação do poder judiciário brasileiro tem sido sempre vista como um desafio para os juristas, porquanto além de um papel judicial vem, ao longo dos anos, também atuando em outras esferas de poder. Este outro viés é oriundo de demandas, que no caso do presente trabalho, são as políticas, surgindo assim o fenômeno da judicialização. Ao falar sobre o tema, é importante referir-se a casos emblemáticos, capazes de ilustrar este protagonismo, e no estudo fiz menção à instituição da fidelidade partidária através da Resolução nº 22.610/07 do TSE. Este debate é importante e ganhou muita força no cenário político-partidário, na medida em que foi instituída uma cláusula de barreira para o troca-troca de partidos. Analisa-se o posicionamento de cada um dos ministros participantes da decisão e solidificação deste marco regulatório, tanto do Tribunal Superior Eleitoral, quanto do Supremo Tribunal Federal pela perspectiva dos ministros. Através deste estudo, é possível fazer conjecturas acerca da legitimação do poder e o desencadeamento de cada uma das justificativas dos ministros para a tomada de decisão e seu impacto na esfera política. O pertencimento do mandato político foi um dos assuntos mais debatidos quando da elaboração da legislação. 10
