L’inquinamento da idrocarburi è uno dei temi più internazionali del diritto marittimo. Il regime internazionale di responsabilità e risarcimento (CLC-FUND) per l’inquinamento da idrocarburi è molto solido ed è il risultato di uno sforzo collettivo degli Stati dopo il disastro della Torrey Canyon. Le fuoriuscite di petrolio dalle navi sono la causa più comune di inquinamento ambientale e possono essere causate da petrolio persistente o non persistente. Questo studio offre una comprensione dettagliata del regime CLC-FUND, insieme a una valutazione specifica dell’inadeguatezza dell’Indian Maritime Shipping Act del 1958 nel far fronte a tali fuoriuscite. Sono stati discussi casi di studio rilevanti per esaminare l’interpretazione giuridica delle convenzioni internazionali. È stato inoltre condotto uno studio sul regime statunitense in materia di inquinamento da idrocarburi, che è parallelo al regime CLC-FUND, poiché gli Stati Uniti non hanno aderito al sistema convenzionale. Infine, l’ipotesi introdotta dall’autore all’inizio del libro ha trovato risposta dopo un’analisi dettagliata delle questioni fondamentali oggetto della ricerca.
