Quizá por desconocimiento o por ingenuidad siempre se ha pensado que, por el hecho de expedir una ley que pretende descongestionar los despachos judiciales, dicho propósito se va a cumplir de manera mágica. Desde la entrada en vigencia de la Constitución Política de 1991 son varias las reformas realizadas al ordenamiento jurídico encaminadas a lograr tal propósito, sin conseguirlo. Una vez más el Congreso colombiano expide una ley que busca agilizar el trámite de los procesos y disminuir la congestión judicial. Así, este libro aborda de manera crítica las reformas introducidas por la ley 1395 del 12 de julio del 2010. Si bien la ley en comento data del año pasado, a la fecha persisten diversas interpretaciones en su aplicación, que bien vale la pena analizar y precisar. Ésta es una de las razones que motivó la publicación de la obra, la cual estamos seguros se convertirá en un texto de obligada consulta para jueces, litigantes y para quienes se interesan en el estudio de las reformas a la Administración de Justicia. 10
