L’acqua potabile, riconosciuta come diritto umano fondamentale dagli strumenti giuridici internazionali e nazionali, rimane inaccessibile a milioni di persone nella Repubblica Democratica del Congo (RDC), in particolare nelle aree periurbane di Bukavu. Nonostante un solido quadro giuridico - tra cui la Costituzione congolese del 2006 e la legge n. 15/026 del 2015 sull’acqua - l’efficacia di questi testi si scontra con sfide strutturali, socio-economiche e istituzionali. Questo studio esplora le contraddizioni tra la consacrazione giuridica del diritto all’acqua e la sua imperfetta attuazione, concentrandosi su Bukavu, una città emblematica delle disuguaglianze nell’accesso ai servizi essenziali. Arricchito da un approccio metodologico rigoroso, questo lavoro propone anche vie concrete per rafforzare i meccanismi di controllo non giurisdizionali e rivedere le sanzioni penali per le violazioni del diritto all’acqua. Oltre a una diagnosi precisa delle disfunzioni del sistema di distribuzione dell’acqua, il libro vuole essere uno strumento di advocacy e di riferimento per lo sviluppo di politiche pubbliche volte a garantire l’accesso universale a questo bene vitale.
