Nicht nur seinem Hauptwerk, dem 1900 erschienenen monumentalen Werk der „Allgemeinen Staatslehre' verdankt er diese Bezeichnung. Hans Kelsen zufolge ist diese die „vollendete Zusammenfassung der Staatslehre des 19. Jahrhunderts'. Auch Schriften, wie das „System der subjektiven öffentlichen Rechte' lösten eine lebhafte Diskussion aus. Noch heute wird die darin enthaltene Statuslehre zur Systematisierung der Grundrechte heran gezogen. Viele der von ihm formulierten Begriffe sind inzwischen zum Gemeingut der Staatslehre geworden. Obwohl in der früheren Bundesrepublik seine Sichtweise von Staat und Recht mancherorts auf Ablehnung oder Unverständnis stieß, wird heute wieder über eine „Anschlussfähigkeit' seiner Thesen nachgedacht, um zeitgemäße Staatsbetrachtung durchführen zu können.
