Depuis l’avènement de 18ième siècle, il est indéniable que chaque Etat moderne et civilisé se penche de la question du respect de droit au procès équitable. Une partie qui est impliquée dans un procès doit d’emblée avoir les chances de présenter ses moyens des défenses dans les conditions optimales et attendre son sort dans le délai légal. Qu’il s’agisse des tenants de la thèse de la victimo-centrisme ou du prévenu centrisme, le respect du délai raisonnable reste indispensable dans la garantie du procès équitable. La doctrine relève qu’il existe trois composantes de procès équitable à savoir l’égalité des armes et des chances, le respect de délai raisonnable et l’exécution effective des décisions judiciaires. Notre réflexion concerne la deuxième composante basée sur la question du respect de délai raisonnable en matière répressive en droit positif congolais tout en se référant aux cas jurisprudentiels de la Cour Européenne des Droits de l’Homme. D’où, nous avons relevé les mécanismes des protections des justiciables face au dépassement arbitraire de délai raisonnable en vue d’assurer le procès équitable aux parties impliquées.
