La peine capitale en Inde reste très controversée en raison de son application incohérente, de l’étendue du pouvoir discrétionnaire des juges et de l’absence d’un cadre uniforme de détermination des peines. Bien que la Constitution impose une procédure équitable, juste et raisonnable, les pratiques des tribunaux reflètent souvent la subjectivité, l’inégalité de traitement et la négligence des facteurs socio-économiques atténuants. Les arrêts de la Cour suprême reconnaissent les lacunes mais n’établissent pas de lignes directrices contraignantes et objectives, ce qui conduit à l’arbitraire, à l’incertitude et au risque d’exécutions injustifiées. Le rapport de 2015 de la Commission juridique a mis en évidence la faible valeur dissuasive de la peine de mort, les lacunes procédurales et les tendances internationales en matière de réforme, tandis que les dissidents ont invoqué la sécurité et la volonté publique. Si la peine de mort est maintenue, l’Inde a besoin de toute urgence de lignes directrices structurées en matière de condamnation, d’une enquête pré-sentencielle, d’une formation judiciaire, d’un soutien pluridisciplinaire en matière de condamnation, de la suppression des incitations des procureurs, d’un respect strict des garanties juridiques, d’un examen périodique des tendances en matière de condamnation et de processus d’exécution en temps opportun. La justice en matière de vie et de mort doit être fondée sur des principes, cohérente, humaine et exempte d’arbitraire.
