Der Verfassungsrichter im frankophonen Schwarzafrika übt durch seine Kontrollinstrumente eine legislative Funktion aus, die über die klassischen Befugnisse, die ihm von der Verfassung zuerkannt werden, hinausgeht. Diese neue Konfiguration der Verfassungsgerichtsbarkeit, die in den Stichprobenländern zu beobachten ist, festigt die Demokratie und die Rechtsstaatlichkeit. Diese Studie soll zeigen, dass sich der Hüter des Verfassungstempels durch seine prätorischen Praktiken unbestreitbar in einen juristischen Gesetzgeber verwandelt hat. In einem wissenschaftlichen Ansatz hat sich die Studie mehr auf die Methoden und Auslegungstechniken des Verfassungsrichters konzentriert, um zu zeigen, dass er legislative Regeln formuliert. Daraus geht hervor, dass der Richter im frankophonen schwarzen Raum durch seine Kühnheit sehr wohl und gut Gesetzgeber ist. Allerdings muss er seine gesetzgeberische Macht mäßigen, um nicht als regierender Richter bezeichnet zu werden.
