Bachelorarbeit aus dem Jahr 2014 im Fachbereich Jura - Zivilrecht / Arbeitsrecht, Note: 1,7, Fachhochschule Trier - Hochschule für Wirtschaft, Technik und Gestaltung, Sprache: Deutsch, Abstract: Es wird sowohl auf die wichtigste BAG-Entscheidung zur Bagatellkündigung als auch auf die „Emmely' Entscheidung eingegangen. Des Weiteren wird ausführlich die geänderte Rechtslage nach der „Emmely'-Entscheidung dargelegt. Aufgezeigt wird die Erforderlichkeit der Abmahnung für die außerordentliche Kündigung. Es folgt eine Auseinandersetzung mit dem seitens des BAG vorgegebenen zweistufigen Prüfungsaufbau des § 626 Abs. 2 BGB. In diesem Zusammenhang werden der unbestimmte Rechtsbegriff „wichtiger Grund' und die Abwägung der Arbeitgeberinteressen mit den Arbeitnehmerinteressen systematisch dargelegt und diskutiert. Im weiteren Verlauf werden die Entscheidungen der Instanzgerichte nach der „Emmely'- Entscheidung erörtert.Darüber hinaus werden die Kritik an und die Konsequenzen aus der „Emmely'- Entscheidung dargelegt. In diesem Zusammenhang werden unter anderem auch die Motive für die Kündigung bei Bagatelldelikten, das Vertrauenskapital, die Wertgrenze für Bagatelldelikte, die bisherige Abmahnung und der Abmahnungsentfernungsanspruch aus der Personalakte beleuchtet. 3
