Der Begriff „Besitz' ist das Ergebnis einer langen Entwicklung, die mit den ersten Gesellschaften begann und bis heute andauert. Aufgrund seiner Bestandteile, die unter anderem römischen, germanischen und gewohnheitsrechtlichen Ursprungs sind, ist er sehr heterogen. Es handelt sich um einen Prozess, der sich ständig weiterentwickelt und verändert, so dass man heute beispielsweise vom Besitz von Forderungen, Aktien und anderen immateriellen Gütern spricht. Diese Komplexität wirft viele Fragen hinsichtlich der Rolle des Besitzes in der heutigen Gesellschaft auf. Um jedoch den aktuellen Begriff des Besitzes verstehen und gründlich kennenlernen zu können, muss man seine Ursprünge und seine lange Entwicklung im Laufe der Jahrhunderte identifizieren. Um den aktuellen Begriff des Besitzes zu untersuchen, ist es notwendig, sich auf die menschlichen Gesellschaften der Vergangenheit und ihre spätere Entwicklung zu beziehen. Dies dient dem Verständnis der Rolle des Besitzes im positiven Recht, das ebenfalls von grundlegender Bedeutung ist.
