Den Ausgangspunkt der vorliegenden Untersuchung bildet die Frage, ob Lenels Entscheidung, den Weinkauf in den Sabinuskommentaren palingenetisch in einer eigenen Rubrik zu verorten, von den Quellen gestützt wird. Obwohl wirtschaftlich dem Kauf zugehörig, konnten Weintransaktionen aus dem Kaufrecht hinausfallen. Im griechischen Recht bildeten Lieferungskäufe über Wein einen eigenen Vertragstyp. Für das römische Recht ergab sich hingegen ein komplexeres Bild. Quellentexte, in denen der Kauf von Wein thematisiert wird, erlauben nur ausnahmsweise dogmatische Rückschlüsse auf andere römisch-rechtliche Vertragstypen. Das romanistische Schrifttum wird daher in Zukunft genau prüfen müssen, innerhalb welcher Grenzen Wein-Fragmente mit anderen vertragsrechtlichen Konstellationen vergleichbar sind.
