Das Recht auf eine gesunde Umwelt ist ein Anliegen sowohl von internationaler als auch von nationaler Bedeutung. In der Stockholmer Erklärung von 1972 werden die Vorboten dieses Rechts genannt. In einer Flut von internationalen und regionalen Menschenrechts- und Umweltverträgen wird die grundlegende Bedeutung dieses Rechts erwähnt. Auf regionaler afrikanischer Ebene haben die afrikanischen Staaten in der Afrikanischen Charta der Menschenrechte und Rechte der Völker das Recht auf eine zufrieden stellende und umfassende Umwelt verankert, die der Entwicklung aller Völker förderlich ist. Die Demokratische Republik Kongo ist in dieser Hinsicht kein Einzelfall und hat sich nicht taub gestellt. Um zu zeigen, wie sehr sie sich für die Verteidigung und Förderung der Menschenrechte einsetzt, hat sie das Recht auf eine gesunde und der ganzheitlichen Entwicklung aller Menschen förderliche Umwelt grundlegend verfassungsrechtlich verankert.
