Die Ärzte-GmbH steht seit langem in der Diskussion. Das Buch untersucht ihre Zulässigkeit und Organbesetzung. Dazu wird das ärztliche Berufsrecht unter eingehender Würdigung der verfassungsrechtlichen Problematik systematisch ausgewertet. Anschließend widmet es sich der Frage, ob Nicht-Ärzten der Zugang zu Gesellschafter- und Geschäftsführerpositionen in der Ärzte-GmbH verschlossen sein kann und die fachliche Weisungsfreiheit des Arztes dennoch gewährleistet bleibt. Außerdem wird untersucht, ob spezielle Berufspflichten für niedergelassene Ärzte auch für angestellte GmbH-Ärzte gelten. Weiteres Thema sind die Abrechnungsmöglichkeiten gegenüber gesetzlichen und privaten Krankenkassen.
