Questa è una riflessione sui diritti umani da una prospettiva decoloniale. Partiamo dalla prospettiva decoloniale della conoscenza, come svolta epistemologica rispetto all’idea che siamo la colonia intellettuale e culturale dell’Europa. Da qui, analizziamo la costruzione storica della Modernità, iniziata con l’invasione dei popoli europei nel continente americano e segnata dalle colonizzazioni del potere, del sapere e dell’essere, che hanno portato all’occultamento della diversità in tutta la Modernità. In questo modo, è possibile dimostrare l’influenza delle colonizzazioni sulla produzione del Diritto Internazionale, più specificamente su ciò che chiamiamo Diritti Umani; avviare alcune riflessioni sul concetto di Diritti Umani, al fine di valutare l’influenza della struttura di potere e di conoscenza stabilita nel sistema-mondo moderno/coloniale sui Diritti Umani. Infine, si propone il dialogo interculturale, attraverso l’ermeneutica diatopica, come alternativa al discorso egemonico dei diritti umani.
