El aumento de casos de divorcio y separación, así como el alto número de niños y niñas que nacen y crecen fuera del contexto de una pareja que cohabita de manera constante, ha hecho que el tema del cuidado personal, la custodia y las visitas a los niños y las niñas abra un intenso debate en Colombia.Este libro busca darles herramientas a los individuos y parejas que están pasando por esta situación, así como a los operadores jurídicos, para tomar decisiones en estos contextos, mostrando cuáles son las normas aplicables y las principales creencias que actualmente subyacen a estas decisiones. Los participantes del sistema están de acuerdo en que es importante darles mayores herramientas de conocimiento y de implementación a los jueces, reducir la aproximación beligerante de los abogados y aumentar el conocimiento del derecho que tienen los usuarios. Actualmente, el pobre funcionamiento del sistema lleva a que muchos individuos tengan que soportar altas dosis de violencia de parte de su pareja para poder tener la seguridad de mantener el contacto con sus hijos. 10
