Le présent travail vise à analyser les nouvelles perspectives relatives à la haute mer, compte tenu du mécanisme international de protection juridique de cet environnement, en ce qui concerne la responsabilité des États en cas de pollution marine. Pour ce faire, il part de l’évolution contemporaine des études en droit international de l’environnement - fondamentalement ancrées dans le principe du développement durable - en mettant l’accent sur la Convention de Montego Bay, qui a innové en présentant une vision juridique holistique de la mer. En outre, il cherche à examiner les faiblesses dans le domaine factuel en ce qui concerne la responsabilité des États pollueurs en haute mer (dont beaucoup découlent des lacunes de la législation internationale), ainsi qu’à démontrer la nécessité urgente d’établir un nouveau paramètre de gouvernance de la haute mer avec une gestion intégrée et coopérative axée sur la conservation et l’utilisation durable de la biodiversité marine.
