Le Protocole de Ouagadougou, dispose qu’en cas où un juge dispose la nationalité d’un État partie à une affaire, il se récuse. Néanmoins, le législateur africain n’a pas expressément défini le bien fondé de ce principe. Cette étude est consacrée à analyser la ration legis de l’article 11 du Protocole relatif à la charte africaine des droits de l’homme, en faisant une étude comparative avec le modèle européen des droits de l’homme.
