Die Problematik der Existenz eines Strafrechts für geistiges Eigentum ist heute Gegenstand von Debatten, da dieser Bereich noch in den Kinderschuhen steckt und sich noch im Aufbruch befindet. Seine Untersuchung weckt noch mehr Interesse, wenn sie im Rahmen des Bangui-Abkommens und im Kontext der Mitgliedsstaaten der Afrikanischen Organisation für geistiges Eigentum (im Folgenden 'OAPI') betrachtet wird. In anderen Ländern haben einige zeitgenössische Autoren, die Vorreiter auf diesem Gebiet waren, das Thema aufgegriffen und den einzigartigen, neuen, technischen und komplexen Charakter dieses Rechts hervorgehoben. Mehr als sechs Jahrzehnte nach dem Abkommen von Libreville hat der neue EU-Gesetzgeber in seinem Bestreben, die Rechte des geistigen Eigentums durchzusetzen und das kriminelle Phänomen der Produktfälschung im OAPI-Raum wirksam zu bekämpfen, systematisch repressive (materielle und formelle) Bestimmungen in das Abkommen und seine Anhänge aufgenommen und die Zuständigkeit für Streitigkeiten den Strafgerichten der Mitgliedstaaten zugewiesen. Heute ist die Frage des IP-Strafrechts im OAPI-Raum ein Thema, das auf großes Interesse stößt und eine Untersuchung verdient.
