Der Terrorismus, ein Phänomen, das so alt ist wie der Krieg, hat sich von einem religiösen Aspekt zu einer politischen Charakterisierung entwickelt. Seit den Anschlägen vom 11. September 2001 hat die Allgegenwart dieses beweglichen Phänomens eine so abrupte Reaktion seitens der Staaten hervorgerufen, dass sie sie als einen Kriegszustand hervorrufend betrachteten. So entstand die Problematik der Anwendbarkeit des Rechts des bewaffneten Konflikts auf den Terrorismus. Bei genauerer Betrachtung hat sich das HVR erst spät mit dem Terrorismus befasst. Seine jüngste Berücksichtigung ist ebenso lückenhaft wie unzureichend. Die Verankerung des Kriegsverbrechens Terrorismus hat es den Ad-hoc-Strafgerichten ermöglicht, die materiellen und moralischen Elemente des Terrorismus zu bestimmen. Dennoch bestehen weiterhin mehrere Unklarheiten in Bezug auf die Definition von Terrorismus und Verwechslungen von ehemals getrennten Begriffen. Einerseits kann das humanitäre Völkerrecht nur dann auf den Kampf gegen den Terrorismus angewandt werden, wenn dieser die Form eines bewaffneten Konflikts annimmt. Andererseits ist das Verbot des Einsatzes von Terrorismus in Zeiten eines bewaffneten Konflikts absolut und seine Verletzung führt zu einem Kriegsverbrechen, einem Verbrechen gegen die Menschlichkeit oder einem Verbrechen des Völkermords.
