L’objectif de cet ouvrage est de combler cette lacune. En fournissant une analyse de base du fonctionnement des clauses NPF et en examinant la jurisprudence dans le contexte de l’investissement international, cet ouvrage expliquera les moyens appropriés pour déterminer si une procédure de résolution des litiges donnée est effectivement plus favorable que la procédure incluse dans le TBI contenant la clause NPF.
