A pesquisa investiga hipóteses de contribuições à autocolocação em risco e heterocolocação consentida em risco avaliando fundamentos para a (não) responsabilização de terceiro, a exemplo de disputas automobilísticas desautorizadas mal sucedidas, uso de droga fornecida por outro com resultado danoso à saúde ou vida do usuário, transmissão de agente etiológico de doença letal mediante relação sexual desprotegida, lesões decorrentes de acidentes ocorridos no contexto de caronas fornecidas por condutor visivelmente embriagado e outros.A disposição de direitos foi estudada na perspectiva da teoria dos direitos fundamentais, sobretudo em sua vertente objetiva e ainda conforme o instituto do consentimento do ofendido. São diferenciadas as hipóteses (i) autolesivas daquelas onde se verifica o (ii) consentimento do ofendido quanto ao resultado lesivo da conduta alheia (heterolesão consentida) e ambos os grupos distinguidos daqueles casos consistentes em (iii) manifestação permissiva do ofendido quanto à participação em situações arriscadas com predomínio de controle da situação mais ou menos acentuado por terceiros (contribuições à autocolocação em risco e heterocolocação consentida em risco). São estudadas e oferecidas soluções fundamentadas na teoria da imputação objetiva roxiniana (funcionalismo teleológico) bem como na teoria da tipicidade conglobante zaffaroniana (funcionalismo redutor). 10
