Partindo do advento das consequências nocivas causadas pela veiculação de desinformação no contexto da pandemia de covid-19 no Brasil, a presente pesquisa intenta sugerir que a insuficiência da dogmática jurídica para a construção de um debate sério sobre a criminalização das fake news pode ser solucionada com a inserção de um estudo baseado na psicologia das massas, ramo do conhecimento psicológico que investiga o comportamento do indivíduo em grupo. Com base nas contribuições teóricas de Gustave Le Bon e Sigmund Freud, é possível concluir que as fake news são um fenômeno de massas. A análise do funcionamento e mecanismo das fake news como forma de manipulação dos indivíduos permite o entendimento de que elas podem ser consideradas uma espécie de fraude que viola o direito à informação e corrompe a liberdade de escolha e autonomia da vontade individual. A introdução do aporte teórico da psicologia das massas enseja, ainda, a superação da aparente dicotomia entre criminalização das fake news e a defesa da liberdade de expressão e de imprensa, além de propiciar uma epistemologia apropriada para subsidiar a reação do direito penal ao fenômeno da construção e disseminação de discursos fraudulentos, como forma de obtenção de vantagem política ou financeira, que assola o Brasil. 10
