L’apparence joue aujourd’hui un rôle de pierre angulaire de l’État de droit. Aussi n’est-il pas étonnant de voir les études se multiplier sur les différents aspects de l’apparence : transparence, sincérité, etc. L’apparence reflète à travers un aspect extérieur un caractère vraisemblable, faisant remonter le fond à travers la forme. Cet aspect extérieur, visible de tous et par tous, se retrouve notamment dans divers pans du droit public : comportement des acteurs publics, encadrement esthétique des sujets et objets de droit, sanction et décision de justice, etc. Une tension apparaît alors. L’apparence exerce une influence décisive sur la normativité de la règle. En parallèle, l’apparence peut se détacher de la réalité à laquelle elle renvoie. Serait-elle donc trompeuse ? La simple présence de l’apparence interroge. Quelles sont ses formes en droit public ? Son contenu matériel reflète-t-il son contenu substantiel ? Quelles sont les conditions de sa normativité ? L’apparence en droit public est-elle sincérité, transparence, tolérabilité, ou vision de l’esprit ? Il s’agit de comprendre les logiques juridiques guidant l’expression de l’apparence de la norme de droit sous un angle interdisciplinaire. Les multiples avatars de l’apparence prennent pleinement leur sens en droit public. En effet, ces derniers participent à l’acceptation du droit tout en étant critère d’appréciation du droit.
