O Tribunal Penal Internacional (TPI) abriu, até à data, processos controversos exclusivamente em África. Estão em curso no Tribunal processos relativos a 25 pessoas, respeitantes a crimes alegadamente cometidos em seis Estados africanos: Líbia, Quénia, Sudão (Darfur), Uganda (Exército de Resistência do Senhor, LRA), República Democrática do Congo e República Centro-Africana. Um 26º caso, contra um comandante rebelde do Darfur, foi arquivado. O Procurador do TPI ainda não conseguiu obter qualquer condenação. Além disso, o Procurador deu início a exames preliminares, potenciais precursores de uma investigação completa, na Costa do Marfim, na Guiné e na Nigéria, bem como em vários países fora de África, como o Afeganistão, a Colômbia, a Geórgia, as Honduras e a República da Coreia. Os processos do TPI têm sido elogiados pelos defensores dos direitos humanos. Ao mesmo tempo, a escolha dos casos pelo Procurador do TPI e a perceção de que o Tribunal se tem concentrado desproporcionadamente em África têm sido controversas.
